1.1 This document constitutes the terms of service between end-users of the Pixwith.AI website and the Pixwith.AI service. 'Pixwith.AI' refers to the Pixwith.AI website, services, and all provided functionality for the remainder of this document.

1.2 These terms must be adhered to by all users of the Pixwith.AI image and video generation services and are agreed upon during account creation.

1.3 If you do not agree to these terms, you must not use Pixwith.AI's services, and you must delete your account if you have already created one.

2.1 An account is required to access the AI image and video generation functionality of Pixwith.AI.

2.2 You may not share an account with any other person or entity, and must keep your account information reasonably secure.

2.3 You are responsible for all actions and requests that your account performs, and must ensure that they do not violate these terms.

2.4 Your account may be terminated at any time for violation of these terms.

2.5 If your account is terminated, there is no guarantee of future availability of your data nor of a refund for any credits you may have purchased.

2.6 Pixwith.AI will make an attempt to ensure its services have high reliability and support as many clients as possible. However, no guarantee of availability or uptime is made by Pixwith.AI.

2.7 Pixwith.AI is not liable for any liabilities or damages caused by the use of its services, nor from the usage of images or videos generated using our service.

2.8 Pixwith.AI reserves the right to change these terms of service at any time, and will attempt to notify you of any changes.

3.1 Pixwith.AI operates on a pay-as-you-go model. Purchases award the user with Pixwith.AI credits ('Credits'), a type of virtual credit used to generate images and videos.

3.2 Credits may only be used for the purpose of generating images and videos on Pixwith.AI.

3.3 Credits are not redeemable for cash or for any other goods or services.

3.4 Credits may not be transferred to any other user.

3.5 Credits do not expire and remain in your account until used for generation services.

3.6 All purchase amounts are stated in US Dollars. The amounts listed on the website do not include applicable taxes such as sales taxes, which are assessed by our payment processor.

3.7 We reserve the right to modify credit pricing at any time with reasonable notice to users.

4.1 Refund Policy for One-time Credit Purchases:

• Within 7 days of successful purchase, if you have not used any credits or services, you may request a full refund.

• Once you have used any credits or services, based on your remaining credits, you may request a partial refund.

• Special circumstances: If there are persistent, significant technical failures (caused by our service) after your purchase that completely prevent you from using your purchased credits, and we verify this to be true, we may provide a full or proportional refund. You must contact customer service promptly after discovering the issue and provide necessary information.

4.2 Non-refundable situations include but are not limited to:

• Refund requests made after the 7-day refund window

• Dissatisfaction with AI generation quality, style, or content (unless results are completely unusable or severely inconsistent with core functionality, and not due to user input issues)

• Issues caused by user failure to follow usage instructions

• Problems caused by user's device or network environment

• Unsatisfactory results due to inappropriate user input (incorrect, vague, or policy-violating content)

• User deliberately or excessively using services then requesting refunds

• User violations of terms of service

• Service interruptions due to force majeure (natural disasters, major cyber attacks)

• Change of mind after purchase when services have been partially or fully used

5.1 No claims on the ownership or copyright of AI-generated images and videos are made by Pixwith.AI, and all created content may be freely used by yourself for commercial and non-commercial purposes.

5.2 AI model output may sometimes be unpredictable and is not guaranteed to match the input prompt nor to be of any given nature or quality.

5.3 Do not attempt to generate content that is illegal in your legal jurisdiction or within your country or district of residence.

5.4 Do not access our generation service via any means other than the pixwith.ai website. Only real human interactions are allowed.

5.5 Do not use generated content as a substitute for any licensed profession, including but not limited to legal advice, financial advice, medical advice, or any other professional service or advice.

5.6 You are solely responsible for the content you generate and how you use it.

6.1 Pixwith.AI stores basic user information during your use of our service.

6.2 Data retention policy:

• User account information is stored for the duration of your account

• Generated content is stored temporarily during processing and may be cached for performance

• You may request deletion of your data at any time by contacting support

• Deletions of images, videos, accounts and other assets are final and irreversible

6.3 Pixwith.AI prioritizes the privacy and security of your data and implements advanced measures to protect it.

6.4 Your creations are private by default and not shared unless you choose to do so.

7.1 In accessing and using Pixwith.AI, you agree to abide by the following restrictions:

a. You will not modify, translate, adapt or reformat Pixwith.AI

b. You will not decipher, decompile, disassemble, or reverse-engineer the software or materials comprising Pixwith.AI

c. You will not interfere with or circumvent any security feature of Pixwith.AI

d. You will not use Pixwith.AI to gain unauthorized access to our or any third party's data, systems or networks

e. You will not use Pixwith.AI in any manner that could damage, disable, overburden, or otherwise interfere with our systems

f. You will not remove, change or obscure any copyright, trademark notice or other proprietary rights notices

g. You will comply with all applicable laws in your access and use of Pixwith.AI

h. You are not allowed to use any automation to access our service - only real human interactions are permitted

i. You will not generate content that is unlawful, harmful, defamatory, abusive, harassing, or otherwise objectionable

You shall not generate or attempt to generate content that:

a. Is unlawful, harmful, libelous, defamatory, abusive, racially or ethnically offensive, harassing, threatening, or otherwise objectionable

b. Would constitute, encourage or provide instructions for a criminal offense or violate any law

c. May infringe any patent, trademark, trade secret, copyright or other intellectual property right

d. Contains or depicts minors in any inappropriate context

e. Is designed to harass, threaten, or harm individuals or groups

f. Violates anyone's privacy or publicity rights

g. Contains viruses, malware, or other harmful code

h. Is in our sole judgment, objectionable or may expose us or others to harm or liability

THE PIXWITH.AI SERVICES ARE PROVIDED TO YOU ON AN 'AS-IS' AND 'AS AVAILABLE' BASIS AND THE USE THEREOF IS AT YOUR SOLE RISK.

WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

A. PIXWITH.AI WILL BE TIMELY, ERROR-FREE, SECURE OR UNINTERRUPTED

B. PIXWITH.AI WILL MEET YOUR REQUIREMENTS

C. THE ACCURACY OR RELIABILITY OF GENERATED CONTENT

D. ANY ERRORS OR MALFUNCTIONS WILL BE CORRECTED

WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF PIXWITH.AI, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Pixwith.AI and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

a. Your use of our services

b. Your violation of these terms

c. Your violation of any third-party rights

d. Content you generate using our services

11.1 You may terminate your account at any time by contacting us at [email protected]

11.2 We may terminate or suspend your account immediately, without prior notice, for conduct that we believe may harm Pixwith.AI, other users, or third parties

11.3 Upon termination, your right to use our services will cease immediately

11.4 Unused credits are forfeited upon account termination

These terms shall be governed by and construed in accordance with the laws of the jurisdiction where Pixwith.AI operates, without regard to its conflict of law provisions.

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our website. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.
